Did you know that certain nonresident employees who live in the District of Columbia, Kentucky, Maryland, Pennsylvania, or West Virginia commute daily to work in Virginia and receive wages for services performed in Virginia for an employer within Virginia’s geographical boundaries are exempt from withholding requirements?
Virginia Wage and Hour Laws
Virginia’s minimum wage legislation requires that employees be paid $7.25*** per hour.
Except for: employees of employers with at least four workers (including the employee’s spouse, parents, or children), all employees of employers with at least four workers are protected:
- workers who are protected by the Fair Labor Standards Act (FLSA)
- commission-based outside salespeople;
- employees or agricultural workers
- employees working in mostly public-supported charitable institutions;
- cab drivers and operators;
- people whose earning capacity is affected by physical or mental impairment;
- those who get paid on a piece-rate basis;
- workers under the age of 16 or those beyond the age of 64;
- full-time students under the age of 18 who work no more than 20 hours per week; and full-time students under the age of 18 who work no more than 20 hours per week.
- students of any age who are enrolled in a full-time work-study program or an educational institution’s equivalent.
