Missouri Wage and Hour Laws

Employees covered by Missouri’s minimum wage legislation must be paid at least $10.30 per hour.

Except for the following personnel, who are not covered:

  • individuals with executive, managerial, or professional responsibilities;
  • Salespeople who are paid largely on commission;
  • some agricultural laborers; a person hired as a substitute for tuition, housing, or other costs;
  • those who are protected by the Interstate Commerce Act; and
  • persons working in retail or service enterprises having a gross revenue of less than $500,000.

Missouri Payroll for Employers

Employers who are subject to Missouri’s wage payment statute are required to pay wages at least twice a month. The law applies to all businesses and manufacturers doing business in the state.

Missouri Income Tax Withholding

Employers in Missouri are required to withhold state income tax from employees’ pay and return the amounts withheld to the Division of Taxation and Collection of the Missouri Department of Revenue.

Every employer who pays salaries to covered workers and has an office or does business in Missouri is required to withhold Missouri income tax.

Employers in Missouri are required to provide employees enough time off to vote. In Missouri, all businesses must provide their employees time off to vote if they do not have enough time to vote before or after work. The scope of this overview is limited to private employers. Unless employees have three consecutive nonwork hours while the polls are open, employers must enable employees to take up to three hours of voting time away.
