Oklahoma Wage and Hour Laws

Employers must pay at least $7.25*** per hour to covered employees.

Except for the following personnel, who are not covered:

      • employees who are covered by the Fair Labor Standards Act (FLSA) or other federal wage and hour regulations;
      • outside salespeople; those in executive, administrative, or professional positions;
      • Agricultural laborers;
      • Students under the age of 22; workers of any carrier subject to Part I of the Interstate Commerce Act;
      • individuals under the age of 18 who have not completed a vocational or high school education; and
      • Employees that work fewer than 25 hours per week and are not on a permanent basis.

Oklahoma Payroll for Employers

Employers subject to Oklahoma’s wage payment statute are required to pay salaries at least twice a month on pre-determined paydays. Paydays for regular employees cannot be more than 11 days after the conclusion of a pay month. According to the federal Fair Labor Standards Act, management personnel must be paid at least once a month.

Oklahoma Income Tax Withholding

Employers in Oklahoma are required to withhold state income tax from their workers’ pay and return the amounts withheld to the Oklahoma Tax Commission’s Withholding Tax Division.

State income tax must be withheld from earnings received by residents and nonresidents in the state by all employers paying wages subject to withholding. If an Oklahoma person earns earnings that are subject to withholding in another jurisdiction, no withholding is needed in Oklahoma. If the other state does not have an income tax legislation, the employer is required to withhold Oklahoma tax from earnings received in that state.

Employers in Oklahoma are required to provide employees enough time off to vote if certain requirements are met.

If employees do not have enough time to vote before or after work, all employers in Oklahoma must provide them time off to vote. The scope of this overview is limited to private employers. Employers must provide employees up to two hours of paid time off to vote. Employers that are too far away from the polls for their employees to vote within two hours must allow enough time for them to travel to and from the polls as well as vote.
